I TRANSMIT herewith a copy of a despatch, as marked in the margin, which has been received from His Majesty's Ambassador at Washington, respecting the proposed Agreement between His Majesty's Government and the United States Government for the mutual protection of British and American trade-marks in China.
You will notice that the United States' Government are prepared to authorize their Consular Courts to punish an infringement by an American citizen of a British-owned trade-mark, subject to previous registration in the United States, on the understanding that American trade-marks, registered in Great Britain, shall receive similar protection in the British Consular Courts.
It was not the intention of His Majesty's Government, when putting forward their proposal, in accordance with the suggestion in your despatch No. 156 of 3rd May last, that the protection to be afforded to trade-marks in China should be conditional on their previous registration in some other country, and I should be glad to be furnished with your opinion whether, in the case of the United States or of any of the other countries which have been approached in the matter, an arrangement founded on that basis would be satisfactory in practice.
I inclose for your information a copy of the Agreement with the United States for the reciprocal protection in Morocco of British and American trade-marks.†
